Impaired Driving and Hit and Run - Stifer Penalties

Quebec, Decembre 2nd 2009. - New penalties to Road Safety will be added starting December 6th 2009 to offences related to impaired driving, refusal to follow an officer's directives or any hit and run.

Alcohol
Stiffer penalties for impaired driving. The following is an overview of the changes that have been introduced in Bill 42:

  • Immediate 90-day licence suspension;
  • Seizure of the vehicle for 30 days if the driver's blood-alcohol level is above 160 mg/100 ml, for a repeat offence or for a refusal to provide a breath or blood sample, or a refusal to submit to physical coordination tests.
  • Licence revoked for a longer period if a driver's blood-alcohol level is above 160 mg/100 ml or for a refusal to obey the order of a peace officer.
  • Longer period for mandatory use of an alcohol ignition interlock device if a driver's blood-alcohol level is above 160 mg/100 ml, or for a refusal to obey the order of a peace officer (or mandatory use of a device for life if a driver has 2 impaired driving convictions for a blood-alcohol level above 160 mg/100 ml, or for a refusal to obey the order of a peace officer).
  • The reference period for determining a repeat offence is 10 years.

Hit-and-Run and Refusal to Stop When Pursued by Police
The penalty for individuals who commit a hit-and-run offence (failure to stop after being involved in an accident) or who refuse to stop when pursued by police is now more severe. In both instances, the driver's licence will be revoked for 4 years (5 years for a repeat offence).

The reference period for a repeat offence is 10 years.
