Assault: Common, Aggravated and with a Weapon<\/h2>\n

A person commits an assault when they apply force, or attempt or threaten to apply force, against another person without that person’s consent.<\/p>\n

Common assault (section 266)<\/h2>\n

This applies where there is no significant injury. Maximum penalty: 5 years’ imprisonment.<\/p>\n

Assault with a weapon or causing bodily harm (section 267)<\/h2>\n

Almost any object can be considered a weapon. Bodily harm is an injury that interferes with the victim’s health or comfort and that is more than merely transient or trifling in nature. Maximum penalty: 10 years’ imprisonment.<\/p>\n

Aggravated assault (section 268)<\/h2>\n

The victim is wounded, maimed or disfigured, or their life is endangered. Maximum penalty: 14 years’ imprisonment.<\/p>\n

Defending yourself<\/h2>\n

Self-defence, consent or insufficient evidence may lead to an acquittal. In other cases, a negotiated resolution or a discharge may be considered.<\/p>\n
