Possession and Trafficking of Narcotics
The Controlled Drugs and Substances Act prohibits possession of narcotics without a valid prescription (section 4), as well as trafficking and possession for the purpose of trafficking (section 5). For cannabis, the Cannabis Act and the Loi encadrant le cannabis apply instead.
Penalties Vary Widely
The sentence depends mainly on the substance and the quantity seized. For simple possession of a drug such as cocaine or an opioid, the maximum penalty is 7 years of imprisonment. Trafficking is punished much more severely.
Defences
Several elements can be challenged: the legality of the search or the arrest, the proof of possession, or the intent to traffic. Depending on the circumstances, an acquittal or a discharge may be possible.
