Uttering Threats Charge (Section 264.1 of the Criminal Code)

Uttering Threats Charge (Section 264.1 of the Criminal Code)

A person commits an offence when they knowingly utter or convey a threat, regardless of the means used: in person, by telephone, by text message, by email or on social media.

Three Types of Threats

  • Causing death or bodily harm to someone;
  • Burning, destroying or damaging property;
  • Killing, poisoning or injuring an animal that belongs to someone.

Penalties

A threat of death or bodily harm is punishable by a maximum sentence of 5 years of imprisonment. Threats against property or an animal are punished less severely.

Defending Yourself

Context is decisive: words spoken in anger or as a joke do not always constitute a threat within the meaning of the Criminal Code. Your lawyer will analyze the words used, the circumstances and the intent.
