Impaired Driving: Licence Suspension and Vehicle Seizure

Impaired Driving: Licence Suspension and Vehicle Seizure

An arrest for impaired driving by alcohol or drugs opens two separate files that proceed in parallel:

  • the criminal file, before the court;
  • the driving record file, with the Société de l’assurance automobile du Québec (SAAQ).

Decisions made in one can affect the other. The two must therefore be managed together to limit the consequences of the arrest.

Immediate Measures

In most cases, your licence is suspended on the spot for 90 days and your vehicle is seized for 30 days, even before a judge rules on guilt.

A Review Is Sometimes Possible

In certain cases, it is possible to apply for a review of this suspension. The time limits to act are short: contact a lawyer quickly to find out whether your situation allows it.
