Speed Limiters on Heavy Trucks: The 105 km/h Rule

Since 2009, in Quebec as in Ontario, most heavy trucks must be equipped with an activated speed limiter set to a maximum of 105 km/h. The rule applies to trucks manufactured since 1995.

Who is responsible?

The driver must not operate a truck whose speed limiter is deactivated or improperly set. The owner and the operator must ensure that the speed limiter complies with the rules. Road enforcement officers can verify the setting with a device connected to the vehicle.

Penalties

A non-compliant speed limiter can result in fines for the driver and for the company, in addition to an entry on the PEVL record. Regular speeding offences also apply, along with their demerit points.

Contesting a ticket

The verification method, the device used, any possible exemptions and the truck’s year of manufacture can all be examined. A speeding offence report can also be contested on the basis of the measurement (radar, speed measuring device).
