Impaired Driving: Lifetime Ignition Interlock Device After a Repeat Offence

In Quebec, since November 25, 2019, a person found guilty of a second offence of impaired driving within a 10-year period must drive with an ignition interlock device for life.

Before this change to the Code de la sécurité routière, a lifetime ignition interlock requirement was imposed only after a third offence, or after a second offence where aggravating factors were present, such as a very high blood alcohol concentration or a refusal to provide a sample.

Can the requirement be lifted?

In some cases, yes. After 10 years, it is possible to apply to the Court of Quebec to have the requirement lifted. However, this option is not available to those with multiple repeat offences.

Penalties as of the arrest

As of the arrest, the Code de la sécurité routière generally provides for an immediate 90-day licence suspension, a 30-day vehicle seizure, and an assessment of your alcohol consumption habits by the SAAQ.

Because a first conviction counts toward the calculation of a repeat offence for 10 years, every case deserves a serious defence from the outset.
