Cannabis Production and Cultivation: What Remains Prohibited in Quebec

The legalization of cannabis in 2018 did not make everything permissible. In Quebec, several acts remain prohibited and can lead to prosecution.

What is permitted

  • Possessing up to 30 g of dried cannabis in a public place, except where it is prohibited;
  • Possessing up to 150 g of dried cannabis in a residence.

What remains prohibited in Quebec

  • Growing cannabis at home, even for personal use, unlike in other provinces;
  • Selling cannabis anywhere other than at the SQDC;
  • Supplying cannabis to a person who is under the legal age (21 in Quebec);
  • Driving while impaired by cannabis.

Statement of offence or criminal charge?

For certain offences under the Cannabis Regulation Act, a police officer may issue a statement of offence rather than lay a charge before the court. Larger-scale production and trafficking, on the other hand, can lead to serious criminal charges.
