Criminal Harassment (Section 264 of the Criminal Code)
Criminal harassment consists of acting toward a person, without lawful authority, in a way that causes them to reasonably fear for their safety or the safety of someone they know.
A Range of Conduct
- Following a person from place to place;
- Repeatedly communicating with them, directly or indirectly, including by text message or on social media;
- Watching their home or workplace;
- Engaging in threatening conduct toward them or their family.
Depending on its seriousness, a single act may sometimes be enough to justify a charge.
Possible Penalties
A conviction can result in a sentence of up to 10 years of imprisonment.
Defending Yourself
Several defences may apply depending on the facts, including those relating to intent or to whether the fear was reasonable. Negotiation can also lead to a favourable outcome, such as an absolute discharge.
