I was found guilty without being able to defend myself in court
Yes, there is a remedy. If you were found guilty by default, because you did not receive the ticket or the notice of hearing, or because you could not attend for a serious reason, our lawyers can file an application for revocation of judgment.
If it is granted, the judgment is set aside and your file goes back to the hearing stage: you regain the right to defend yourself. In the meantime, we can also request a stay of execution to suspend the consequences of the judgment, in particular the entry of demerit points or the suspension of your licence.
IMPORTANT: the application must be filed quickly, in principle within 30 days of the moment you became aware of the judgment. The longer you wait, the harder it becomes to convince the court.
Just discovered a conviction you did not know about? Contact us without delay with the documents you received (notice of judgment, SAAQ letter, driving record): 514 990-7884.
